San Juan County, Utah, Commissioner Phil Lyman is planning to appeal his conviction and sentencing related to an illegal ATV ride in May 2014. On Tuesday, Lyman filed notice with U.S. District Court that he will appeal an alleged “conflict of interest” in the trial, as well as his sentence. After his conviction, Lyman had charged that the trial judge was biased. That judge then recused himself from the sentencing. Monte Wells of Monticello, also convicted in the ride, has filed an appeal as well. Both men had been sentenced to short jail terms and three years’ probation, and ordered to pay $96,000 restitution. Lyman plans to act as his own attorney. Wells has a public defender.

The police chief of Monticello, Utah, has been fired over his handling of a 911 call. KUTV news in Salt Lake reports that the City Council voted 5 to 0 Tuesday to terminate Chief Kent Adair. He had been put on leave in December after criticism of the response to a call in which the estranged wife of a Monticello police officer reported her ex had broken into her home, assaulted a man, and driven away intoxicated. Officers reportedly did not respond for 10 hours. The dispatcher and Adair allegedly joked about the situation in a phone call. The estranged husband was charged with aggravated burglary and assault.
